Ratings in Deutschland und den USA

The credit ratings of rating agencies have a substantial influence on the funding of listed companies on the international capital markets. To what extent the liability of national and international agencies is procedurally enforceable is the central theme of this study. Neda von Rimon explains the economic backgrounds of ratings, elucidates the historic development of agencies and analyses how they are financed. In her study she compares the German, European and US legal frameworks for the activities of rating agencies and concludes by presenting the advantages and disadvantages of the American and European regulatory methods.



Dr. Neda von Rimon studierte Rechtswissenschaften an der Juristischen Fakultät der Gottfried Wilhelm Leibniz Universität Hannover . Im Anschluss besuchte sie den Masterstudiengang in International Business Transactions and Comparative Law der University of San Francisco.

Inwieweit eine prozessual durchsetzbare Haftung für national sowie international agierende Agenturen erfolgsversprechend ist, steht im Mittelpunkt dieser Untersuchung. Neda von Rimon erläutert die ökonomischen Hintergründe von Ratings und die historische Entwicklung der Agenturen. Sie vergleicht den deutschen, europäischen und US-amerikanischen Rechtsrahmen der Tätigkeit von Ratingagenturen, um Vor- und Nachteile der amerikanischen und europäischen Regulierungsmethoden aufzuzeigen.
